Hypothetical Example of "Off The Clock" Wage Claim

Suppose a full time, $10.00 per hour employee performed pre-shift and post-shift "off the clock" work-related duties as well as performed work during unpaid meal periods for a total of 4 hours per week over a three-year period. Suppose further a court found willful violations and applied liquidated (double) damages for the wage violations under the Fair Labor Standards Act.

Such "off the clock" unpaid wage claims could be calculated as follows:

$10.00 x 4 hours per week x 150 (weeks) x 1.5 (overtime rate) x 2 (liquidated damages) = $18,000.00
